U.S. Court of Appeals Case No: 09-2805
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Colloton, Author, with Riley, Chief Judge, and
   Benton, Circuit Judge]
Criminal case - Criminal law. District court did not err in admitting evidence of a prior arrest involving marijuana and a firearm as the incident was similar in material respects to the current charges, and the probative value of the evidence outweighed any danger of unfair prejudice; jury instructions on the firearm offense contained some incorrect language but there was not a reasonable likelihood that they misled the jury to convict defendant based on an incorrect standard; evidence was sufficient to support defendant's conviction for use of a firearm during and in connection with a drug trafficking offense.
