U.S. Court of Appeals Case No: 09-2841
U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED] [Colloton, Author, with Riley, Chief Judge, and
Benton, Circuit Judge]
Criminal case - Sentencing. 18 U.S.C. Sec. 2252a(5)(B) permits
separate convictions for illegal images stored on different devices, and
defendant's convictions do not violate the Fifth Amendment; even
assuming that multiple counts may be charged for images stored on
different media only if the prohibited images were obtained through
different transactions, the evidence here showed that the images were not
all obtained at the same time.
