U.S. Court of Appeals Case No: 09-2894
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Melloy, Author, with Loken and Hansen, Circuit Judges]
Criminal Case - supervised release. District court did not clearly err in
concluding Asalati committed an assault. District court did not err in
imposing a lifetime term of supervision and curfew, out of concern for
public safety and his dangerous nature, not his alien status. Lifetime term
is necessary under the circumstances and imposition of curfew was
reasonably related to the protection of the public.
