U.S. Court of Appeals Case No: 09-2906
U.S. District Court for the Northern District of Iowa - Dubuque
[PUBLISHED] [Riley, Author, with Colloton and Benton, Circuit Judges]
Civil case - torts. Replevin action undertaken against a lessee who was
in default under the lease agreement did not terminate the lease; nor did
any terms of the lease act to terminate the lease; as a result, the lease was
in effect at the time of the accident in question; plaintiffs' vicarious
liability claims against GMAC as the lessor of the vehicle were barred by
Iowa law and the Graves Amendment (49 U.S.C. Sec. 30106(a)); district
court did not err in dismissing plaintiffs' negligence claims against
GMAC.
