U.S. Court of Appeals Case No: 09-2945
and No: 09-3124
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Bright, Author, with Loken and Gruender, Circuit Judges]
Criminal case - Sentencing. District court did not err in relying on
unscored criminal history to impose an upward variance; claim of
sentencing disparity rejected as the differences between defendants'
sentences were based on legitimate distinctions in their conduct;
defendant Jones's sentence was not unreasonable; no error in imposing an
obstruction of justice enhancement against defendant Hawkins as he lied
to investigators and gave his brother false information to provide to them;
no error in denying defendant Hawkins's request for an acceptance-of-
responsibility reduction; no error in imposing an enhancement for use of
a minor; no error in applying the cross-reference set out in Guidelines
Sec. 2k2.1(c)
