U.S. Court of Appeals Case No: 09-2990
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Loken, Author, with Bright and Wollman, Circuit Judges]
Civil case - Antitrust. Defendants' judgment on claims seeking to force
InBev to divest Anheuser-Busch is affirmed; while the price benefit beer
drinkers would gain from divestiture is uncertain, a court decree splitting
the now-combined operations would impose a serious hardship on
employees and distributors and might well damage competition and
consumers by crippling the operations of the largest domestic producer of
immensely popular products; in such circumstances, the remedial equities
balance overwhelmingly in favor of denying divestiture.
