U.S. Court of Appeals Case No: 09-3041
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED][Wollman, Author, with Murphy and Shepherd, Circuit Judges]
Criminal case - criminal law and sentencing. Indictment sufficiently
alleged the offense of conspiracy to commit money laundering; no error
in admitting defendant's tax returns as the information was relevant to
show a plan to conceal the transactions in question; district court did
not err in refusing to permit defendant to suggest the jury could draw an
inference from a missing witness; no error in rejecting defendant's
proposed jury instruction defining proceeds as the instruction was not
consistent with this circuit's decisions; evidence was sufficient to support
conviction for conspiracy to commit money laundering; no error in
imposing enhancements under Guidelines Sections 2S1.1(b)(1) and
2S1.1(b)(2)(c); no error in denying request for a three-level minor role
reduction.
