U.S. Court of Appeals Case No: 09-3111
U.S. District Court for the Northern District of Iowa - Dubuque
[PUBLISHED] [Benton, Author, with Chief Judge Riley and Colloton,
Circuit Judges]
Criminal Case - conviction and sentence. District court did not abuse its
discretion in denying motion to withdraw guilty plea and did not show a
fair and just reason for withdrawing plea before sentencing. Denial of
acceptance of responsibility adjustment was not clear error in light of
attempts to withdraw his guilty plea. Any error in applying enhancement
under section 2G2.2(b)(3)(B) was harmless error. Admission of
videotapes at sentencing was not an abuse of discretion. Judge Colloton
concurs.
