U.S. Court of Appeals Case No: 09-3115
U.S. District Court for the District of Nebraska - North Platte
[PUBLISHED] [Murphy, Author, with Wollman and Shepherd,
Circuit Judges]
Civil case - torts. In toxic tort strict liability action the district
court did not err in limiting plaintiffs' experts' testimony about
causation as the testimony was not based on scientific testing or
exposure analysis and was too speculative to be admitted; since plaintiffs
could not establish the cause of the injured worker's toxic exposure
or the concentration of that exposure, the district court did not err
in granting defendant's motion for summary judgment.
