U.S. Court of Appeals Case No: 09-3163
and No: 09-3312
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Murphy, Author, with Wollman and Shepherd, Circuit
Judges]
Criminal Cases - conviction. Based on confidential informant's track
record and corroboration of significant aspects of the tip, officers
reasonably inferred that defendants were attempting to engage in illicit
drug transaction and accordingly district court did not err in denying
motion to suppress. Sufficient evidence was presented to support
conspiracy conviction. District court did not abuse its discretion in
refusing jury instruction on the distinction between conspiracy to
distribute and simple buyer/seller transaction. District court did not abuse
its discretion in admitting into evidence photograph of cash and drugs
seized at the scene and did not affect substantial rights.
