U.S. Court of Appeals Case No: 09-3196
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Murphy, Author, with Beam and Benton, Circuit
Judges]
Criminal Case - conviction. Conviction for three bank robberies and
three related firearm offenses are affirmed. District court did not clearly
err in finding government's reasons for striking juror to have been race
neutral and did not abuse its discretion in denying motion to exclude all
gang-related evidence, as the evidence was relevant to establish his
identity as the gunman in the robberies and the district court limited the
scope of the evidence to issues of identity and impeachment.
