U.S. Court of Appeals Case No: 09-3276
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Riley, Author, with Clevenger and Colloton, Circuit Judges]
Civil case - ERISA. The plan administrator did not err in determining
the amount of Dr. Khoury's base salary for purposes of disability
payments; according to the provisions of the plan, an employee's basic
monthly earnings did not include overtime, and the plan administrator's
determination that certain additional pay Dr. Khoury received for on-call
time was overtime and not part of base salary was a reasonable
interpretation of the plan's provisions.
