Criminal case - Sentencing. It was not error for the court to hear a
sentencing statement concerning a dropped charge as the information
concerned defendant's background, character and conduct; no error in
imposing a four-level enhancement under Guidelines Sec. 2B1.1(b)(2) for
the number of victims, and any error was harmless in light of the court's
statement that the same sentence would be imposed whether a two or
four-level enhancement was applied; no error in imposing an upward
variance based on the nature of defendant's conduct and its impact on the
victims.
