U.S. Court of Appeals Case No: 09-3322
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Melloy, Author, with Hansen and Smith, Circuit Judges]
Civil case - employment discrimination. Reviewing the record in the
light most favorable to plaintiffs, there are genuine questions of material
fact as to whether plaintiffs were subject to a racially hostile work
environment; further, plaintiffs have come forward with sufficient
evidence that the employer knew or should have known about the
harassment and failed to take prompt and effective remedial measures;
the district court erred in granting the employer's motion for summary
judgment, and the judgment is reversed and remanded for further
proceedings.
