U.S. Court of Appeals Case No: 09-3326
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Benton, Author, with Murphy and Beam, Circuit Judges]
Criminal case - criminal law and sentencing. Defendant waived any
objection to admission of money seized from his apartment; officers had
probable cause for defendant's arrest and defendant's statements were
admissible; no error in admitting evidence of a 1993 conviction for
selling cocaine as the evidence was merely cumulative of other evidence
establishing knowledge and intent and the evidence of defendant's guilt
was considerable; limits on cross-examination were within the
permissible bounds of the court's discretion; no error in sentencing
defendant under 21 U.S.C. Sec. 841, as any failure to follow the
procedures set out in 21 U.S.C. Sec. 851 was harmless; excluded
testimony from defendant's former attorney would not have affected the
verdict.
