U.S. Court of Appeals Case No: 09-3398
U.S. District Court for the Northern District of Iowa - Ft. Dodge
[PUBLISHED] [Shepherd, Author, with Murphy and Melloy, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence seized pursuant
to a warrant issued after a warrantless entry was admissible under the
"independent source doctrine" as the officers testified that they would
have applied for a warrant even if they had not entered the residence and
there was probable cause, absent the tainted information, for the issuance
of a warrant; voluntary statements made a day after defendant's release
on bond were admissible; defendant's convictions under Tennessee's
sexual battery statute were crimes of violence for sentencing purposes.
