U.S. Court of Appeals Case No: 09-3427
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED][Wollman, Author, with Hansen and Murphy, Circuit Judges]
Civil Case - hostile work environment discrimination. Reported
harassment was not so severe or pervasive that it met high threshold for a
hostile work environment; four incidents over a two-year period is
insufficient. Harassment did not interfere with job performance. Cross
further did not show Prairie Meadows failed to respond adequately to her
complaints. District court did not err in concluding the evidence was
insufficient to raise genuine issue as to whether Prairie Meadows knew or
should have known about unreported incidents.
