U.S. Court of Appeals Case No: 09-3428
U.S. District Court for the Western District of Missouri - St. Joseph
[PUBLISHED] [Murphy, Author, with Beam and Benton, Circuit
Judges]
Civil case - Individuals with Disabilities Education Act. District court
did not err in finding the school district had met its obligation under the
Act as the Individualized Education Plans it developed for the student set
out his present level of education and measurable goals for the year,
enunciated special services and accommodations and adequately
considered positive behavioral interventions and strategies; even if there
was technical violation of the Act's requirements concerning meetings,
the district court did not err in finding the district had complied with the
Act's requirements of parental notice and participation.
