Civil case - False Claims Act. District court erred in finding it did not
have jurisdiction over relators' qui tam action under the False Claims Act
as the previously-disclosed administrative documents that relators relied
upon did not disclose the essential elements of their claims; because the
plain language of Iowa Code Sec. 147.136 and the legislature's apparent
intent support a conclusion that a plaintiff in a medical malpractice case
cannot recover costs already paid by the government, the defendants had
a reasonable basis in law for their position that they were not obligated to
seek reimbursement, and relators' allegations that defendants were
violating the False Claims Act by seeking federal funds for medical care
resulting from medical negligence without seeking reimbursement from
the tortfeasors failed to state a claim.
