U.S. Court of Appeals Case No: 09-3453
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Smith, Author, with Bye and Beam, Circuit Judges]
Criminal case - Criminal law and sentencing. While the district court
erred in excluding testimony from an inmate to impeach the testimony of
an inmate cooperating with the government because the testimony was
extrinsic evidence of a prior inconsistent statement, the error was
harmless; evidence was sufficient to support defendant's conviction for
possession of child pornography; no error in applying enhancements for
age of the minors depicted in the images or for possession of material
depicting sadistic or masochistic conduct; no error in imposing an
enhancement for obstruction of justice based on defendant's perjury at
trial; no error in imposing a criminal history point for a uncounseled prior
misdemeanor conviction as the conviction did not result in a sentence of
imprisonment.
