U.S. Court of Appeals Case No: 09-3467
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Benton, Author, with Riley, Chief Judge and Colloton,
Circuit Judge]
Criminal case - criminal law and sentencing. Commission of crime in
the police officer's presence provided probable cause to stop defendant;
defendant failed to show the government produced false testimony; no
error in imposing an enhancement for use of a firearm in connection with
the underlying drug offense; court adequately explained its sentencing
decisions; sentencing disparities based on cooperation are not
unwarranted; district court's reliance on the crack-to-cocaine ratio did not
result in an unreasonable sentence.
