U.S. Court of Appeals Case No: 09-3491
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Murphy, Author, with Beam and Benton, Circuit Judges]
Civil case - labor law. Labor agreement in question required transferred
employees to be "endtailed" in seniority with employees at the plant to
which they were transferred, and the fact that the union's bargaining
agent would have been worse off if the transferred employees' request for
"dovetailing" had been adopted did not mean he breached any fiduciary
by failing to negotiate for dovetailing since it could not be imposed
without violating the agreement; further, to negotiate for such a provision
would have breached his duties to the employees of the plant to which the
employees were being transferred.
