defendant in a criminal case and third parties the defendant had served
with subpoena duces tecum, the district court erred in finding it had
ancillary jurisdiction to decide the contract claim as the decision was not
necessary to manage the criminal proceedings, vindicate the court's
authority or otherwise preserve its ability to function successfully.
