Criminal case - criminal law. Federal Rule of Appellate Procedure 4(b) is a non-jurisdictional claim-processing rule; here the government properly objected by motion and in its merits brief that the notice of appeal was untimely as to defendant's judgment of conviction, and that portion of the appeal is dismissed; the appeal was timely as to the district court's denial of defendant's motion to reduce sentence, but that portion of the appeal is meritless, and the district court's order denying the motion is affirmed.
