U.S. Court of Appeals Case No: 09-3676
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Loken, Author, with Bye and Shepherd, Circuit Judges]
Civil case - torts. Under Rule 84 of the Federal Rules of Civil
Procedure and Form 13 of the Appendix to the Rules, plaintiff's
complaint was sufficient to allege employee status, and the district court
erred in dismissing the complaint; even if the issue were not governed by
Rule 84 and Form 13, the complaint plausibly alleged a claim of
employee status.
