U.S. Court of Appeals Case No: 09-3687
U.S. District Court for the District of Nebraska - Lincoln
[PUBLISHED] [Melloy, Author, with Chief Judge Riley and Gruender,
Circuit Judges]
Criminal Case - sentence. District court did not clearly err in finding
defendant assaulted and threatened a witness and was thus justified in
imposing a two-level increase for obstruction of justice. Consequently,
defendant was not entitled to safety-valve relief. District court did not
commit procedural error, as it thoroughly considered but rejected
defendant's motion to vary downward based on sentencing disparity
among defendants. Sentence was not substantively unreasonable.
