U.S. Court of Appeals Case No: 09-3734
U.S. District Court for the District of South Dakota - Pierre
[PUBLISHED] [Melloy, Author, with Riley, Chief Judge, and Bye, Circuit Judge]
Criminal case - Sentencing. Plea agreement which required the
government to recommend a three-level reduction for acceptance of
responsibility did not preclude the government from offering sentencing
evidence that defendant obstructed justice by attempting to persuade the
victim to change her testimony; the district court did not err in
determining that defendant was not entitled to the acceptance-of-
responsibility reduction based on that conduct and his continuing claims
in the community that he was innocent of the charges.
