U.S. Court of Appeals Case No: 09-3785
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Benton, Author, with Riley, Chief Judge, and Beam,
Circuit Judge]
Criminal case - criminal law. In prosecution for possession of illegal
machine guns, the court did not clearly err in admitting a video of
defendant teaching his mother to fire a machine gun as the evidence was
admissible under Rule 404; court did not err in allowing the government
to cross-examine defendant about his military service and discharge as
defendant opened the door on his military service; Second Amendment
does not protect an individual's right to possess a machine gun, and 18
U.S.C. Sec. 922(o) does not violate defendant's Second Amendment right
to bear arms.
