U.S. Court of Appeals Case No: 09-6070
and No: 09-6071
U.S. Bankruptcy Court for the District of Nebraska - Omaha
[PUBLISHED] [Kressel, Author, with Federman and Venters,
Bankruptcy Judges]
Bankruptcy Appellate Panel. Bankruptcy court did not err in denying
Keith Thomas a discharge as the omissions in his petition, schedules and
statements supported the court's inference of fraudulent intent; the court
did not err in granting Patricia Thomas's request for a discharge as there
was insufficient evidence to show she knew and understood that the
petition and statements were inaccurate; bank's appeal was moot in light
of the denial of Keith's request for a discharge; Patricia was not
aggrieved by the court's orders, and her appeal is dismissed for lack of
standing.
