U.S. Court of Appeals Case No: 10-1122
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Arnold, Author, with Shepherd and Bright, Circuit Judges]
Criminal case - Criminal law. Evidence that defendant subjected his
wife to sexual and physical abuse was admissible as it was relevant and
not unfairly prejudicial; even if the district court erred in admitting the
evidence, the evidence of defendant's guilt was overwhelming, and
admission of the evidence did not affect his substantial rights; motion for
new trial was untimely and the district court did not abuse its discretion
by determining there was no excusable neglect for the delay.
