Criminal case - Criminal law. Defendant's three tribal court misdemeanor convictions, while uncounseled, were valid in inception and the prior terms of imprisonment did not violate the U.S. Constitution, tribal law or the Indian Civil Rights Act; as a result, the convictions could be used as predicate convictions to establish the habitual offender elements of 18 U.S.C. Sec. 117. Judge Bye, dissenting.
