Order in question dismissed some, but not all, of the substantive due process and First Amendment claims alleged in the complaint and was not final for purposes of appeal; plaintiff has pleaded her class-of-one claim with sufficient detail to withstand defendant teacher's 12(b)(6) and 8(a)(2) motion; the equal protection right at issue was clearly established under pre-existing law; as a result, the teacher was not entitled to qualified immunity on claims she singled out the student in question and refused to teach her and otherwise mistreated her as the conduct exceeded the scope of professionally acceptable choices and was not discretionary.
