U.S. Court of Appeals Case No: 10-1251
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Bye, Author, with Beam and Smith, Circuit Judges]
Civil case - employment discrimination. Plaintiff's claim that he was
not hired for a position because of his 2004 employment discrimination
suit against the University fails because he cannot establish a causal
nexus between the suit and the decision not to hire; even if plaintiff could
establish a prima facie case by showing a causal connection, he did not
establish that the stated reasons for the University's hiring decision - the
candidates' qualifications and job interview performances - were pretexts
for retaliation; plaintiff's Title VII gender discrimination charge was
properly dismissed as it was not exhausted; turning to the merits of the
Title VII and Section 1983 gender discrimination claims, plaintiff could
not establish causation between his gender and the hiring decision and
could not show the stated reasons for the decision were pretexts for
gender discrimination.
