Criminal Case - conviction and sentence. Evidence was sufficient for a
reasonable jury to conclude that Daniels knowingly possessed the
firearm. The district court did not err in determining that Daniels was
convicted of three prior violent felonies, qualifying him to be an armed
career criminal; and his conduct constituted a crime of violence under
U.S.S.G sec. 4B1.2(a)(1). Daniels did not show the district court clearly
erred in denying his request for acceptance of responsibility after he put
the government to its proof at trial. The district court did not err in
holding two sentencing hearings, as the district court did not enter a final
judgment after the first hearing.
