U.S. Court of Appeals Case No: 10-1299
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Shepherd, Author, with Bright and Arnold, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence seized during
pat-down was admissible as the officer had a reasonable suspicion to
believe defendant was armed and dangerous; defendant did not have
standing to challenge the search of the vehicle in which he was riding as a
passenger; no error in denying motion in limine concerning
pseudoephedrine logs, prior convictions and jail house recordings;
evidence was sufficient to support defendant's convictions for conspiracy
to manufacture meth and conspiracy to tamper with a witness; district
court did not err in finding defendant qualified for sentencing as a career
offender; any error in calculating the amount of drugs involved in the
offense was harmless because defendant's base offense level was
calculated based on his career offender status.
