U.S. Court of Appeals Case No: 10-1333
U.S. District Court for the Northern District of Iowa, Waterloo
[PUBLISHED] [Gruender, Author, with Arnold and Shepherd, Circuit
Judges]
Criminal case - Sentencing. The First Amendment does not require a
reasonable mistake-of-age defense to the charge of producing child
pornography, and the district court did not err in denying defendant's
request to introduce such a defense; considering a post-revocation
sentence in calculating defendant's criminal history did not constitute
double-counting; sentence was not substantively unreasonable under the
facts of the case where defendant sexually exploited two intoxicated,
underage minors.
