U.S. Court of Appeals Case No: 10-1343
U.S. District Court for the District of South Dakota - Pierre
[PUBLISHED] [Murphy, Author, with Wollman and Gruender, Circuit Judges]
Civil Case - Pregnancy Discrimination Act. District court properly
granted summary judgment to employer, as record does not show
employee suffered any adverse employment action, let alone that she was
constructively discharged. Even if employee established intolerable
conditions, she did not show an intention to force her to quit or that
employer could have reasonably foreseen that she would quit. Employee
failed to provide employer with necessary opportunity to remedy the
problem.
