U.S. Court of Appeals Case No: 10-1379
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Loken, Author, with Smith and Colloton, Circuit Judges]
Criminal case - Criminal law and sentencing. Evidence was sufficient
to support defendant's firearm and robbery convictions; challenge to
admission of confession rejected; no error in imposing sentencing
enhancements based on amount taken and on obstruction of justice for
perjury; there was no evidence presented that a robbery committed two
days earlier was committed in preparation for the robbery of the credit
union and, as a result, the district court erred in imposing enhancements
based on the conduct (physical restraint and carjacking) in the earlier
robbery.
