U.S. Court of Appeals Case No: 10-1477
and No: 10-2038
and No: 10-2040
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Benton, Author, with Smith and Beam, Circuit Judges]
Civil Case - USERRA. The district court's determination there was
insufficient evidence that Lisdahl experienced objectively intolerable
working conditions following his military service or that any actions were
taken against him on the basis of his veteran status is affirmed.
Constructive discharge claim failed as a matter of law because Lisdahl
did not complain of treatment. Grant of summary judgment to employer
on claim coworkers were retaliated against is affirmed, as coworkers did
not demonstrate materially adverse employment actions were taken.
