U.S. Court of Appeals Case No: 10-1498
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Shepherd, Author, with Smith and Colloton, Circuit Judges]
Criminal Case - sentence. District court properly applied the definition of
a prior felony conviction from Guidelines section. 4B1.2 and thus properly
determined defendant should be sentenced as a career offender. Coleman's
sentence within the advisory guideline range is accorded presumption of
reasonableness, but even if it did not apply, sentence was reasonable.
Argument that career offender Guidelines are unsupported by empirical
evidence is not an issue of substantive reasonableness.
