Civil Case - civil rights. Private settlement agreement in which the
district court took no action judicially sanctioning or materially altering
the legal relationship of the parties did not make appellant prevailing
party entitled to attorneys fees. Grant of qualified immunity to officer
who remained in the house 10-15 minutes after being told to leave was
proper, as officer was assisting child services investigator and it was not
clearly established that the officer was required to leave in the middle of a
child neglect investigation. Judge Shepherd dissents from the grant of
qualified immunity.
