U.S. Court of Appeals Case No: 10-1700
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Riley, Author, with Beam and Benton, Circuit Judges]
Civil case - Labor law. Trans States Airlines had standing to challenge
the arbitrator's award as violative of the Labor Management Reporting
and Disclosure Act; a challenge to a district court arbitration award based
on the argument that it violates public policy is reviewed under a de novo
standard and not under a "manifest disregard" for the law standard;
Association's payments to a pilot were not an improper loan; as a result,
the district court did not err in finding the arbitrator's award did not
violate the public policy of Section 503(a) of the Labor Management
Reporting and Disclosure Act.
