U.S. Court of Appeals Case No: 10-1702
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Wollman, Author, with Bye, Circuit Judge, and
Fleissig, District Judge]
Civil case - Minnesota Farmer-Lender Mediation Act. Viewing the
evidence in the light most favorable to plaintiff, the record failed to create
a genuine issue of material fact that the property in question was
principally used for farming; as a result, foreclosure of the homestead
parcel did not constitute a loss of farmland, equipment, crops or livestock,
and it was not covered by the Act; complaint did not adequately plead
fraud. Judge Bye, dissenting.
