U.S. Court of Appeals Case No: 10-1768
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Colloton, Author, with Loken and Smith, Circuit Judges]
Criminal case - Sentencing. District court erred in concluding that every
conviction for the Minnesota offense of making a terroristic threat was a
crime of violence for sentencing purposes; however, the error was
harmless because the record is clear that the district court intended to
impose the same sentence with or without the Guidelines Sec.
2L1.2(b)(1) enhancement.
