U.S. Court of Appeals Case No: 10-1770
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Murphy, Author, with Smith and Benton, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence seized during a
warrantless search of defendant's vehicle was admissible as the police
officers had reasonable suspicion that criminal activity was afoot and
probable cause to believe that contraband and evidence of that activity
would be found in the vehicle; no error in imposing a four-level
enhancement under Guidelines Sec. 2B1.1(b)(2)(B) based on the number
of victims of defendant's credit card fraud.
