U.S. Court of Appeals Case No: 10-1789
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Murphy, Author, with Riley, Chief Judge, and Melloy,
Circuit Judge]
Criminal case - criminal law and sentencing. Police were acting in good
faith under Leon when, pursuant to a court order and rules governing the
disposal of seized evidence, they opened defendant's flash drive and
unexpectedly discovered child pornography; evidence was sufficient to
support defendant's conviction for possession of child pornography;
evidentiary challenges rejected; no error in imposing enhancements for
number of images, sadistic content and use of a computer; sentence was
not substantively unreasonable; conditions in defendant's supervised
release concerning use of computers, the internet and cameras were not
an abuse of the court's discretion; limits on defendant's contact with
minors were also appropriate.
