Civil case - Employment discrimination. In action alleging employer committed employment discrimination in violation of the Uniformed Services Employment and Reemployment Act, the district court did not err in granting summary judgment for the employer as plaintiff failed to present sufficient evidence to allow a reasonable jury to find the employer was hostile to his membership in the armed forces or that his membership was a motivating factor in the termination decision; employer had cause , under the Act, for terminating plaintiff.
