Criminal case - Criminal law. Allegation of prosecutorial misconduct
rejected; no error in admitting witness's testimony as it was plainly
relevant to the existence of and defendant's participation in the charged
conspiracy; no error in admitting tapes of defendant rapping on drug
topics as the tapes were admissible under Rule 404(b); assuming for
discussion purposes that admission of the tapes violated Rule 403, any
error in admitting them was harmless in light of the overwhelming
evidence against defendant; claims of ineffective assistance of trial counsel
should be brought in a Sec. 2255 proceeding.
