U.S. Court of Appeals Case No: 10-2061
U.S. District Court for the Northern District of Iowa, Waterloo
[PUBLISHED] [Melloy, Author, with Hansen and Benton, Circuit Judges]
Civil case - Employment Discrimination. District court did not err in
finding plaintiff was not a qualified individual within the meaning of the
Americans with Disabilities Act and the Iowa Civil Rights Act as he
could not perform the essential functions of the job - operating light and
medium heavy equipment - because he could not drive or work around
moving machinery as a result of his condition.
