U.S. Court of Appeals Case No: 10-2178
U.S. District Court for the Western District of Missouri - Joplin
[PUBLISHED] [Murphy, Author, with Loken and Baldock, Circuit Judges]
Criminal case - Criminal law. Constitutional challenges to the felon in
possession statutes rejected, as the statutes do not violate the Second
Amendment or the Commerce Clause; district court did not abuse its
discretion by denying defendant's motion for a continuance and his motion
for removal of his second appointed attorney; district court did not
commit plain error when it did not, sua sponte, give a limiting instruction
on Rule 404(b) evidence; the evidence was sufficient to support
defendant's conviction for being a felon in possession of explosives.
